Colleton Regional Hospital v. MRS Med. Review Systems, 866 F.Supp. 891 (D.S.C. 1994) and 866 F.Supp. 896 (D.S.C. 1994). BMSM represented MRS Medical Review Systems, Inc., a utilization review company. Three hospitals brought actions as assignees of ERISA (Employee Retirement Income Security Act) beneficiaries. In the first decision, the district court held that the hospitals' state law claims against MRS were preempted by ERISA. The hospitals were allowed to amend their complaint to state an ERISA claim. In the second decision, the court held that MRS was a non-fiduciary under ERISA, and dismissed the hospitals' action against MRS in its entirety. J. Marshall Allen, David S. Cox
