John C. Hawk and Ashley A. Kutz Deliver SC Tort Reform Update at SCDTAA Joint Meeting, July 2010

At the 2010 South Carolina Defense Trial Attorneys (SCDTAA) Joint Meeting, John Hawk and Ashley Kutz were invited to speak on the current state of tort reform in South Carolina.
Mr. Hawk and Ms. Kutz educated members on South Carolina’s success and shortcomings related to tort reform. During their presentations, Mr. Hawk and Ms. Kutz provided the SCDTAA members with an analysis of several timely topics related to tort reform, including: caps on punitive damages, joint and several liability, and standards for the admissibility of evidence in tort cases.
After evaluating South Carolina’s tort reform rankings, the presentation addressed H. 3498 and S. 350, recent proposed legislation introduced in the 118th General Assembly.
Attendees included business litigation, construction, insurance, employment, trucking and trial attorneys from across the State of South Carolina.
John C. Hawk is a litigator who focuses his practice on Products Liability, Construction, Business Litigation, and Insurance. He has experience litigating civil matters in both state and federal court involving trade secrets, contracts, enforcement of arbitration provisions, employment discrimination, personal injury and products liability.
Ashley Kutz received her J.D. from Valparaiso University School of Law in 2008 where she was a recipient of the Jurist Scholarship, the Executive Managing Editor of the Valparaiso University Law Review, and an Associate Member of the Moot Court Honor Society. In addition to her J.D., Ms. Kutz completed a Master of Science in International Commerce and Policy in 2008. In 2004 she received her B.A. in English and Political Science (double major) from Rhodes College. Ms. Kutz’s areas of practice are Admiralty and Maritime, Business Litigation, Civil Litigation and Employment.
